RA 9280 - Customs Brokers Act of 2004

Amendments under RA 9853​

RA 9853 amended three (3) sections of RA 9280:

  1. Section 6 – Scope of Practice of Customs Broker Profession
  2. Section 27 – Export Declaration
    • Revised to an β€œeither… or” statement.
    • Allows exporters the option to solely sign the export declaration without a Customs Broker.
  3. Section 29 – Admission to Professional Practice
    • Sets the threshold minimum paid-up capital of β‚±1,000,000 (One Million Pesos) before being accredited by the Bureau of Customs (BOC).

  1. Creation of the PRBCB

    • Professional Regulatory Board for Customs Brokers (PRBCB) was established to supervise and regulate the profession.
  2. Licensure Examination (75/60 Rule)

    • Examination administered by the Professional Regulation Commission (PRC).
    • Passing criteria:
      • Must obtain 75% average rating across all subjects
      • No grade lower than 60% in any subject.

  3. Code of Ethics and Technical Standards

    • Customs Brokers are bound by a code of ethics and technical standards.
